AGB
General Terms and Conditions
Section 1 – Vendor, inclusion by reference of the General Terms and Conditions
- The Vendor and contracting party for the goods presented in our online shop „www.totalequipro.de“ is Total EquiPro, Drosselgasse 19a, 48480 Lünne, phone 05906-6799933, e-mail info@totalequipro.de (referred to hereinbelow as the “Vendor” for short).
- The present General Terms and Conditions are a component part of any contractual agreement made between the Vendor and the respective Customer. The Vendor hereby objects to any terms and conditions that the Customer may have established and that contradict the present General Terms and Conditions.
Section 2 – Goods offered and conclusion of contract
- The Vendor is offering the goods presented in this online shop for sale. The colors of the goods shown on the website may vary slightly depending on the internet browser and monitor settings used by the Customer; these variations are technically unavoidable. The selection of goods, conclusion of contract and implementation of the agreement shall all take place in German or English to the Customer’s discretion.
- The Vendor is making a binding sales offer for the goods presented in the shop. By transmitting the order using the button “kaufen” the Customer accepts the sales offer. The Vendor shall confirm the conclusion of the contract by e-mail (contract confirmation).
- Before finally placing the purchase order, the Customer is shown an overview of the data recorded for his order, including the essential characteristics of the goods. At this point, the Customer may check the data for any incorrect input and, if necessary, go back one or more steps in the order process to change the data or completely discontinue the order.
- After conclusion of the contract, the Vendor sends the content of the contract (contract text) to the customer by e-mail. At the same time, the Vendor stores the contract text in his electronic data processing. As the Customer cannot access the Vendor’s data, it is the customer’s responsibility to save the e-mail with the contract text for later reference.
Section 3 – Prices and payment
- All product prices are total prices plus shipping costs. Prices include VAT.
- Information on shipping costs can be found with the respective product description.
- The Customer can use the following payment methods: Advance payment by bank transfer, PayPal, Klarna, Credit Card / Debit Card. Payment is due immediately upon conclusion of the contract.
- Shipment will only be made after full payment has been received (pre-payment). For bank transfers, a payment period of 7 days from receipt of the contract confirmation applies. The Vendor reserves the goods for this period. If no payment is received within 7 days, the Vendor may rescind the contract.
- Retention of Title: The goods remain the property of the Vendor until full payment has been received.
- For deliveries outside the EU, customs duties/taxes may apply and must be paid by the Customer.
Section 4 – Shipment, delivery periods
- Information on delivery time can be found in the respective product description. An indication in days refers to the period from the full receipt of payment by the Customer until delivery of the goods.
- If the Customer’s order contains more than one good, all goods will be delivered in one single shipment; for this shipment, the longest given delivery period for any of the contained goods will apply. If the Customer wishes a good to be delivered separately in shorter time, he may place a separate order for that good.
- Where a delivery cannot be made because the Customer has provided a wrong or incomplete shipping address, an attempt to once again deliver the goods shall be made only if the Customer accepts to bear the costs of re-shipping the goods.
Section 4a – Subscriptions (“Abo & sparen”)
- For goods with the purchase option “Abo & sparen” (subscribe and save), the Customer chooses a delivery interval (every 2 weeks, every month, every 2 months or every 3 months). The order establishes a contract for the regular delivery of the selected goods at this interval. The first delivery is made like an ordinary order; the Vendor automatically places each further order at the chosen interval.
- With a subscription, the Customer receives a 10% discount on the item price. The price shown in the checkout when the subscription is concluded applies, plus the shipping costs per delivery stated there. Price changes apply to a running subscription only if the Customer agrees to them.
- Only payment methods that allow recurring payments are available for subscriptions; they are shown in the checkout. The Vendor charges the payment method chosen for the first order each time a follow-up order is placed. If a payment fails, the Vendor retries it up to three times at intervals of seven days; if it does not succeed, the subscription ends and the Customer is informed by e-mail.
- The subscription has no minimum term. The Customer may cancel it at any time without giving reasons, via the button “Verträge hier kündigen” (cancel contracts here) at www.totalequipro.de/en/pages/vertraege-kuendigen or in text form, e.g. by e-mail to abo@totalequipro.de. The cancellation applies to all orders not yet placed when it is received; if an order is nevertheless placed afterwards, the Vendor cancels it and refunds any amounts already paid. The Vendor may cancel the subscription in text form with four weeks’ notice.
- If an item is out of stock when a follow-up order is placed, the Vendor retries the order up to five times on the following days. After that, this delivery is skipped at no cost to the Customer; the Customer is informed by e-mail and the subscription continues.
- Section 5 applies to the right of withdrawal. For a subscription, the withdrawal period begins as soon as the Customer, or a third party other than the carrier named by the Customer, takes possession of the first goods.
Section 5 – Right of withdrawal for consumers
- A Customer purchasing as consumer is entitled to a right of withdrawal in accordance with the statutory pre-requisites. A consumer means every natural person who enters into a legal transaction for a purpose that is mainly outside his commercial or self-employed professional activity.
- The pre-requisites and legal consequences of the German stipulations as to consumers’ rights of withdrawal shall apply to consumers having their permanent residence outside of Germany also in those cases in which the consumer’s national law does not provide for a right of withdrawal or provides for a shorter withdrawal period or for stricter requirements as to form.
Section 6 – Warranty
Warranty claims shall be governed by the statutory regulations.
Section 7 – Out-of-court Dispute Resolution
We are neither obliged nor willing to participate in consumer dispute resolution proceedings.
Section 8 – Final provisions
- The laws of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
- Contract Language: The contract can be concluded in German or English. In the event of any conflict or inconsistency between the German and English versions of these GTC, the German version shall prevail.
- Should individual provisions be invalid, the remaining provisions shall remain in effect.
